These Terms and Conditions govern your access to and use of Poolr. By accessing or using Poolr, you agree to these Terms. If you do not agree to these Terms, do not use Poolr.
1. About Poolr
Poolr is a golf pool software platform that allows users to create and join golf tournament prediction pools, submit picks, view pool rules, follow leaderboards, and receive tournament-related updates. Poolr provides software tools for organizing and participating in golf pool experiences.
2. No Gambling, Betting, Wagering, or Prize-Money Processing
Poolr is not a gambling platform, sportsbook, betting platform, wagering platform, casino, lottery, fantasy sports operator, or prize-money processing service. Poolr does not collect, hold, manage, distribute, transfer, process, or guarantee prize pools, wagers, bets, winnings, entry fees, or user-to-user payments.
Any arrangements between users outside of Poolr are solely between those users. Poolr is not responsible for, and does not facilitate, any such arrangements. Poolr sells access to software features and tournament pool management tools only.
3. Accounts
You may need an account to access certain Poolr features. You are responsible for providing accurate information, keeping your login credentials secure, and for all activity that occurs under your account. You agree not to create an account using false or misleading information.
4. Pool Creation and Participation
Pool creators are responsible for setting pool rules, inviting participants, and managing their pools. Participants are responsible for reviewing the applicable pool rules before submitting picks. Poolr may lock picks at the scheduled tournament start time or at another time determined by the pool settings.
Users are responsible for ensuring that their picks are submitted before the applicable deadline. Poolr is not responsible for missed submissions, late picks, user error, internet issues, device issues, or other circumstances that prevent a user from submitting or editing picks on time.
5. Payments and Purchases
Poolr may charge for premium pool creation, subscriptions, or other software features. Payments are processed by a third-party payment provider. Poolr does not store full credit card numbers.
All Poolr purchases are for access to Poolr software features and services only. Purchases are not wagers, bets, entry fees, winnings, prize pools, or user-to-user payments. Unless otherwise required by law, purchases may be non-refundable once access to the purchased software feature has been provided.
6. Subscriptions
Poolr may offer subscription plans that provide access to certain premium features. Subscription terms, pricing, billing frequency, and included features will be shown at the time of purchase. Subscriptions may renew automatically unless canceled according to the cancellation process provided by Poolr or the applicable payment provider.
7. Text Message Notifications
If you provide your phone number and opt in to receive text messages, Poolr may send transactional text messages related to your account, pools, tournament reminders, pick submissions, leaderboard updates, and final results. Message and data rates may apply. Message frequency may vary.
You may reply STOP to opt out of text messages or HELP for help. Opting out of SMS messages may prevent you from receiving certain Poolr notifications by text message, but you may still use Poolr.
8. User Conduct
You agree not to misuse Poolr. You may not:
- Use Poolr for unlawful, fraudulent, deceptive, or abusive activity.
- Attempt to access accounts, data, systems, or features without permission.
- Interfere with or disrupt Poolr's operation, security, or performance.
- Submit false, misleading, harmful, offensive, or unauthorized content.
- Use Poolr to process, collect, manage, or facilitate gambling, wagering, betting, prize-money, or entry-fee payments.
- Reverse engineer, scrape, copy, or misuse Poolr data or software except as permitted by law.
9. Tournament Data and Results
Poolr may use third-party tournament data, scoring data, player data, odds data, field data, and leaderboard data. While Poolr works to provide accurate and timely information, Poolr does not guarantee that all data will be accurate, complete, current, error-free, or available at all times.
Poolr may correct, update, or adjust data, scores, leaderboards, or results if errors, delays, third-party data issues, or scoring issues occur.
10. Availability and Changes to Poolr
We aim to keep Poolr available and reliable, but we do not guarantee uninterrupted access. Poolr may be unavailable due to maintenance, updates, technical issues, third-party outages, data provider issues, internet disruptions, or events outside our control. Poolr may modify, suspend, or discontinue features at any time.
11. Intellectual Property
Poolr and its software, design, branding, content, features, interfaces, and related materials are owned by Poolr or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from Poolr except as permitted by these Terms or with written permission from Poolr.
12. Account Suspension or Termination
Poolr may suspend or terminate your access to the platform if we believe you have violated these Terms, created risk for Poolr or other users, used Poolr unlawfully, abused Poolr features, or engaged in conduct that may harm Poolr, users, or third parties.
13. Disclaimers
Poolr is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Poolr disclaims warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.
14. Limitation of Liability
To the fullest extent permitted by law, Poolr will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost data, lost goodwill, business interruption, loss of use, or other losses arising from or related to your use of Poolr.
15. Indemnification
You agree to defend, indemnify, and hold harmless Poolr and its owners, operators, employees, contractors, service providers, and affiliates from and against claims, damages, liabilities, losses, costs, and expenses arising from your use of Poolr, your violation of these Terms, your violation of law, or your misuse of Poolr.
16. Changes to These Terms
Poolr may update these Terms from time to time. Updated Terms will be posted on this page with an updated “Last updated” date. Your continued use of Poolr after updated Terms are posted means you accept the updated Terms.
